Terms and Conditions - Senior Defender

1. Acceptance of Terms

By accessing and using Senior Defender ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Senior Defender is a web-based safety tool that helps users, particularly seniors, avoid scam links and malicious emails. The Service provides URL and email scanning capabilities using multiple security reputation services, SMS-based scanning, and browser extension functionality.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and update your information to keep it accurate, current, and complete
Maintain the security of your password and identification
Accept all responsibility for activities that occur under your account
Notify us immediately of any unauthorized use of your account

3.2 Account Types

The Service offers Free and Premium subscription plans. Free accounts have limited scanning capabilities. Premium accounts provide enhanced features including unlimited scans and access to additional security services.

4. Subscription and Payment Terms

4.1 Premium Subscriptions

Premium subscriptions are billed monthly at $4.99 USD per month. By subscribing to Premium, you agree to pay the subscription fee in advance on a monthly basis.

4.2 Payment Processing

Payments are processed through Stripe, a third-party payment processor. You agree to provide valid payment information and authorize us to charge your payment method for all fees due.

4.3 Automatic Renewal

Premium subscriptions automatically renew each month unless cancelled. You will be charged the subscription fee on the same day each month until you cancel.

4.4 Cancellation

You may cancel your Premium subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

4.5 Refunds

Refunds are provided at our sole discretion. Generally, refunds are not available for subscription fees already paid, except as required by law.

4.6 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will be communicated to you at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new price.

5. Acceptable Use

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
Transmit any material that is abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or invasive of another's privacy
Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks
Interfere with or disrupt the Service or servers or networks connected to the Service
Use automated systems (bots, scrapers) to access the Service without permission
Reverse engineer, decompile, or disassemble any part of the Service
Use the Service to scan URLs for malicious purposes or to test security systems
Exceed reasonable usage limits or attempt to circumvent rate limiting

5.2 Rate Limiting

Free accounts are subject to monthly scan limits. Premium accounts may have higher or unlimited limits. We reserve the right to implement rate limiting to prevent abuse and ensure service availability for all users.

6. Privacy and Data Protection

6.1 Data Collection

We collect and process information as described in our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

6.2 URL and Email Scanning

When you submit a URL or email address for scanning, we transmit this information to third-party security services (VirusTotal, Google Safe Browsing, Microsoft Defender SmartScreen, etc.) for analysis. These services may retain information about scanned URLs in accordance with their own privacy policies.

6.3 Data Storage

We store scan results, account information, and usage data on secure servers. We implement reasonable security measures to protect your data, but cannot guarantee absolute security.

6.4 Data Retention

Free account users' scan history is retained for 30 days. Premium account users' scan history is retained indefinitely unless the account is deleted. We may delete inactive accounts and associated data after a reasonable period of inactivity.

7. Intellectual Property

7.1 Our Content

The Service and its original content, features, and functionality are owned by Senior Defender and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing the Service.

7.3 Third-Party Services

The Service uses third-party security services and APIs. These services are subject to their own terms of service and intellectual property rights.

8. Service Availability and Modifications

8.1 Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

8.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

8.3 Feature Changes

We may add, remove, or modify features of the Service at any time. Premium features may be added to Free accounts or vice versa at our discretion.

9. Disclaimers and Limitations of Liability

9.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Security Scanning Disclaimer

While we use multiple reputable security services to scan URLs and emails, we cannot guarantee that:

All malicious content will be detected
All safe content will be correctly identified as safe
Scan results are 100% accurate or current
The Service will prevent all security threats

You use the Service at your own risk. We are not responsible for any damages resulting from reliance on scan results.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENIOR DEFENDER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

9.4 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Senior Defender, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party right, including without limitation any copyright, property, or privacy right
Any claim that your content caused damage to a third party

11. Third-Party Services and Links

11.1 Third-Party Security Services

The Service relies on third-party security services including VirusTotal, Google Safe Browsing, Microsoft Defender SmartScreen, and others. These services are provided by independent third parties and are subject to their own terms of service and privacy policies.

11.2 Third-Party Links

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any third-party content, goods, or services.

11.3 Payment Processing

Payment processing is handled by Stripe, a third-party payment processor. Your use of Stripe's services is subject to Stripe's terms of service and privacy policy.

11.4 SMS Services

SMS functionality is provided through Twilio, a third-party SMS service provider. Your use of SMS features is subject to Twilio's terms of service and privacy policy.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features in your dashboard. Upon termination, your right to use the Service will immediately cease.

12.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms
Fraudulent, abusive, or illegal activity
Non-payment of subscription fees
Extended period of inactivity
Request by law enforcement or government agency

12.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and all associated data. We are not obligated to retain your data after termination.

12.4 Survival

Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Dispute Resolution

By providing your phone number and using SMS features, you consent to receive text messages from Senior Defender. Standard message and data rates may apply.

15.2 Opt-Out

You may opt out of SMS communications at any time by replying "STOP" to any message or by contacting support. After opting out, you will not receive further SMS messages, but you may still receive important account-related communications.

15.3 SMS Frequency

SMS messages are sent in response to your scan requests. Message frequency varies based on your usage of the Service.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

Posting the updated Terms on this page
Updating the "Last Updated" date
Sending email notifications to registered users for material changes

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may terminate your account.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Senior Defender regarding the Service and supersede all prior agreements and understandings, whether written or oral.

19. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.
